In connection with the temporary suspension of the collection of the International Transfer Airport User Fee (TUUA), initially scheduled to take effect on October 27, Lima Airport Partners informs the public as follows:
- LAP acknowledges and appreciates the commitment of the Ministry of Transport and Communications (MTC) and OSITRAN, as representatives of the Peruvian State, to formally recognize the obligation to uphold the terms established in the Jorge Chávez International Airport Concession Agreement and its Addendum No. 6, which grants LAP the right to apply a Unified Airport User Fee (TUUA) applicable to transfer passengers connecting through Lima.
- In this context, it is important not to misinterpret the announcement issued by the MTC. While LAP has expressed its full readiness to postpone the collection of the TUUA until December 7 at the latest, this also entails compliance by the MTC with specific commitments undertaken during the working session held on October 23, including the following:
(i) The MTC will promote the amendment of the Regulations of the Civil Aeronautics Law in order to ensure that all air transport costs are included in, and clearly and transparently communicated through, air tickets, for the benefit of passengers.
(ii) At the same time, progress will be made on the proposed addendum to adjust the amount of Domestic Transfer Passenger Fee applicable to domestic flights, analyzing alternatives by the Government to avoid affecting users while ensuring the recovery of the private investment made by the concessionaire. This charge is not in effect at this time.
- In line with the commitments undertaken, OSITRAN and its Board of Directors will continue the tariff-setting process in accordance with the applicable regulations, upholding the principles of predictability, legality, and objectivity expected of the regulatory authority.
LAP will continue to closely monitor compliance with the commitments undertaken and calls for due process to be observed, to ensure that any decisions regarding the setting of this fee are transparent, technically sound, and consistent with the applicable legal framework.
